Regarding Maintenance of Property

 

Subject:          Clarification of Section 8.1 “Maintenance of Property”

 

Authority:      The Declaration, Articles of Incorporation, and Bylaws of the Association and Colorado law.

Resolution:

 

Whereas Section 8.1 of the First Amended and Restated Master Declaration of Covenant Conditions and Restrictions for Grant Ranch states that “No property within the Association Area shall be permitted to fall into disrepair, and all property within the Association Area, including any Improvements and landscaping thereon, shall be kept and maintained in a clean, safe, attractive and sightly condition and in good repair” and; whereas, the term “disrepair” is not defined nor are the standards of what is considered a “clean, safe, attractive and sightly condition and in good repair”.

 

Now, therefore, be it resolved by the Board of Directors of the Grant Ranch Master Homeowner’s Association that the safe condition and good repair shall include, but not be limited to, the following requirements:

 

1.      Snow and ice must be removed from the public sidewalks located on personal property within Grant Ranch within 24 hours, to allow safe usage by pedestrians including those on bicycles, skate boards, roller skates or other non-motorized conveyances.

 

2.      The pruning of tree branches or other landscaping that extend over the public sidewalk located on personal property within Grant Ranch, to provide adequate overhead clearance and allow safe usage by pedestrians including those on bicycles, skate boards, roller skates or other non-motorized conveyances.

 

3.      The parking or placing of a vehicle, trailer, container, machine, device, structure, or other object, whether temporary or permanent, so as to block any part of a public sidewalk located on private property within Grant Ranch shall be construed to be an unsafe condition.

 

4.      Timely repairs of a cracks or surface section deviations on public sidewalks located on private property within Grant Ranch, to allow safe usage by pedestrians including those on bicycles, skate boards, roller skates or other non-motorized conveyances.
